How can I get divorced?

By mutual agreement, before a notary or a civil registrar (the latter only if you have no minor children), or through the courts. The court can also dissolve the marriage where the relationship has broken down seriously, after the spouses have lived apart for at least 2 years, or on health grounds (Article 373 of the Romanian Civil Code).

How long does a divorce before a notary take?

Once the application is filed, the law provides for a 30-day reflection period. If you both maintain the application at the end of it, the notary issues the divorce certificate. In practice, the procedure takes around 30 to 45 days.

Can I get divorced if I live abroad?

Yes. If you are resident abroad, I can represent you in court without you having to travel to Romania for every hearing (Article 920 of the Code of Civil Procedure). You will need a power of attorney and proof of residence.

What documents do I need for a divorce?

Copies of your identity documents, the original marriage certificate and, if you have minor children, copies of their birth certificates. Depending on the case, other documents may also be needed.

What is a compensatory payment?

A sum that the spouse who is not at fault can claim if the divorce is granted on the grounds of the other spouse's sole fault and the marriage lasted at least 20 years (Article 390 of the Civil Code). It is claimed together with the divorce and compensates for the drop in living standards caused by the end of the marriage.

What can I do if I am a victim of domestic violence?

You can ask the court for a protection order, with measures that can last up to 12 months (Law No. 26/2024). In urgent situations, the police can issue a provisional protection order valid for 5 days. I can help you with the application and represent you in court.
