How long do I have to challenge enforcement?

As a rule, 15 days from the date you learned of the enforcement measure or received the formal demand notice (Article 715 of the Romanian Code of Civil Procedure). The deadline is strict: a challenge filed after it is dismissed as out of time, however well-founded it may be.

Can enforcement be halted until the challenge is decided?

Yes. The court may stay enforcement on application and for good reason. A security deposit, calculated on the amount in dispute, is usually required, and in urgent cases you can also ask for a provisional stay.

How much of my salary can be attached?

No more than one third of your net monthly income for ordinary debts and no more than half for maintenance obligations. Where there are several attachments, the total cannot exceed half of your net income (Article 729 of the Code of Civil Procedure).

Can an old debt still be enforced?

The right to seek enforcement is generally time-barred after 3 years, or 10 years for titles concerning rights in rem (Article 706 of the Code of Civil Procedure). Limitation does not apply automatically: it has to be raised.

Who pays the enforcement costs?

As a rule, the debtor. That is why paying voluntarily or reaching an early agreement with the creditor can significantly reduce the overall costs.

Can I negotiate with the creditor once enforcement has started?

Yes. A payment agreement or a settlement can lead to enforcement being postponed or ended. I can help you negotiate and draft the agreement.
